For the candidates of Uttar Pradesh, the State Government had devised the UP Shiksha Mitra Samayojan in 2014. The examination was held in 2014 in the month of December and following which 91,000 and more candidates were shortlisted and selected for the posts of Assistant Teachers in Primary Schools. Because the people found various flaws in the execution and details of this scheme,the scheme was contested in a court case that took quite some time in resolving. When the case reached the State High Court in Allahabad, the case was immediately dismissed and a stay was put on the implementation of nearly one lakh Assistant Teachers in various primary schools of UP.
All eyes are now on the next hearing which is on 27 July 2016.

The Supreme Court and the High Court of Allahabad took the case with utmost seriousness and examined every level of the scheme for flaws. The came out with the decision of suspending the scheme because of some technical problems in the scheme and the promises it made. The High Court declared the UP shiksha Mitra Samayojan to be illegal and prohibited appointment of Assistant Teachers based on the same. This came as a shocking blow to those candidates that had prepared and cleared the written examination for the posts and were eagerly waiting to start their careers.
The court released a number of statements in this regard. Court said that first of all appointing teachers is not a legal right of the state government. Next, the court said that training individuals through distance education for a career in teaching in unjustified and unconstitutional. Teacher Training Courses are not eligible for distance education. Hence the court also dismissed the two-year BTC course that was been offered by the state government to train teachers.
The Shiksha Mitra Samayojan had promised appointments as Assistant Teachers for more than one lakh candidates when it conducted the exam. The BTC distance education course was supposed to be done prior to appearing in the exam. The selected candidates were going to be appointed for a limited contract period of 11-months following which if their performance was found satisfactory the contract would be renewed. This selection was been made at village-levels by the appointed Village Education Committee. The Court declared that appointing teachers with relaxations was a right of the NTPC and not the state government and nullified the scheme recently.
This issue had rose to attention when the government noticed that in many villages the Shiksha Mitra appointed was also the Gram Pradhan and the candidates appointed were supposed to be temporary appointment and not permanent. After the cancellation of the SM Samayojan the UP government stands embarrassed and answerable to more than 1 lakh 70 thousand SMs that are currently lying suspended.
